Are Consumer Finance Claims a legitimate company?

We certainly are. Consumer Finance Claims is regulated by the Claims Management Regulator in respect of regulated claims management activities. Our authorisation number is CRM16124 which can be checked on the website www.claimsregulation.gov.uk.

Is it Legal?

Yes, lenders or advisers involved in mortgages have to be authorised by the Financial Services Authority or FSA for short. Under the FSA's rules, if you were mis–sold or given wrong advice when you took out your mortgage, then the adviser or lender has to take action to put it right.

Why claim?

Mistakes and bad advice in relation to mortgage products can create massive difficulties for you and can be costly to put right – but you won't necessarily know if you've been given the right advice and are a victim of mis–selling.

If you have been mis–sold, the adviser or lender is required to put you back in the position you would have been if the error or mis–selling hadn't taken place.

How does it work?

Our claims process is pretty straightforward.

Firstly, we will discuss your circumstances with your over the telephone. This will give us an initial view about whether you may have been a victim of mortgage mis–selling.

We–ll then send you out a claim pack which includes a questionnaire which will confirm any details you've already given to us and asks you for any additional information which may be useful in progressing with your claim.

We will complete our own review of your case, based on what you can recall about the mortgage sale as well as reviewing any documentation that you have.

At this stage, we will prepare and submit your claim to the relevant financial company. We will be in regular contact with the company making sure that they are progressing with your claim and we will keep track on any decisions or offers they present.

Of course, we'll make sure you're kept up to date with what's happening and we won't accept or reject any offers without first talking them through with you.

Do I need documentation or copies of agreements?

Any documentation that you have is useful in preparing your claim – you can send the originals to us and we will take copies and return the originals to you.

Don't worry if you don't have any paperwork as the claims pack that we send to you also includes a "letter of authority" which will enable us to obtain copies of the paperwork from the adviser or lender.

Can I have more than one claim?

Yes, we can claim for each case where you have been mis–sold or wrongly advised. So with each time you remortgaged there may be an additional claim.

How long does it take?

Once we submit your claim to the financial company they are required to resolve it within 8 weeks. We will always be looking to make sure they keep to these timescales. However, it can take longer than this, for example, if you're claim is particularly complex. We generally aim to have everything resolved within 12 weeks but still this is only an approximate time scale.

What is the average claim value?

Due to the complex nature of mortgages and the wide range of products and solutions, there's no such thing as an average claims value. The level of redress will differ depending upon what action the adviser or lender needs to take to put things right.

Whenever we get an offer from the company concerned, you can be confident that we'll check it to make sure it's fair and sufficient to compensate you for their actions and will put you back in the correct position.

How much does it cost?

At Consumer Finance Claims we only operate on a "no win no fee" basis* – so it won't cost you a penny upfront and you only pay us if we are successful.

If we win your claim then we receive 20% inclusive of VAT of the compensation value that is due to you.

For example, if the value of the compensation is £10,000 in total, then we will deduct £2,000 to cover our fee and we'll send you a cheque for £8,000 or pay it directly in to your bank account, if you prefer.

Will I have to go to Court?

It is unlikely that you will need to go to court as most cases are able to reach an out of court settlement.

In the unlikely event that we don't reach an amicable conclusion with your lender or mortgage broker, we will have enough documentation prepared for the Financial Ombudsman Service (FOS) or Financial Services Compensation Scheme (FSCS) to mediate in the final stages.

In the unlikely event that court proceedings are required we will notify you at that time.
